Terms and Conditions

Please read these Terms carefully before using KIXIK. By using the Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using KIXIK ("Service", "Platform"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, you may not use the Service.

These Terms apply to all users of the KIXIK platform, including the landing page (kixik.eu), Equipment Portal, and Mechanic Portal.

2. Service Description

KIXIK is a cloud-based equipment management platform that allows businesses to:

  • Track and manage equipment using Smart Tags (NFC/QR)
  • Maintain digital maintenance and service logs
  • Submit and manage service requests
  • Access the platform from any device without a dedicated mobile app

3. Subscriptions and Payment

3.1 KIXIK is offered on a subscription basis. Current pricing is available at kixik.eu.

3.2 Subscriptions are billed annually or monthly as selected at time of purchase.

3.3 All fees are non-refundable unless required by applicable law. If you cancel your subscription, you retain access until the end of the current billing period.

3.4 We reserve the right to change pricing with at least 30 days' prior notice to active subscribers.

3.5 Physical Smart Tags (NFC/QR) are sold separately. Tags are non-refundable once shipped.

4. Service Availability

4.1 We aim to provide reliable and continuous access to the Service but do not guarantee uninterrupted or error-free operation.

4.2 The Service may be temporarily unavailable due to:

  • Scheduled maintenance (we will notify users in advance where possible)
  • Unplanned technical issues or bugs
  • Failures or outages of third-party infrastructure providers
  • Events beyond our reasonable control (force majeure)
Temporary unavailability does not automatically entitle you to a refund or compensation unless otherwise required by applicable law.

5. Third-Party Services

5.1 KIXIK relies on third-party services to operate, including:

  • Supabase (supabase.com) – database, authentication, and backend infrastructure
  • Vercel (vercel.com) – website hosting and delivery

5.2 We are not responsible for outages, data loss, security incidents, or service degradation caused by Supabase, Vercel, or any other third-party provider.

5.3 By using KIXIK, you acknowledge that your data is stored on Supabase infrastructure and subject to their terms of service (supabase.com/terms).

If Supabase or another infrastructure provider experiences an outage, KIXIK may be temporarily unavailable. This is outside our direct control and does not constitute a breach of these Terms.

6. Data and Backups

6.1 You retain full ownership of all data you enter into KIXIK, including equipment records, maintenance logs, and service requests.

6.2 You are responsible for maintaining independent backups of your data. KIXIK provides data export functionality for this purpose.

6.3 KIXIK is not liable for data loss resulting from service interruptions, third-party failures, accidental deletion, or any other cause.

6.4 Upon cancellation of your subscription, your data will be retained for 30 days. After this period, data may be permanently deleted.

7. Acceptable Use

You agree not to:

  • Use the Service for any unlawful or fraudulent purpose
  • Attempt to gain unauthorized access to other accounts or systems
  • Reverse engineer, decompile, or copy any part of the Service
  • Use the Service to store or transmit malicious, harmful, or illegal content
  • Resell, sublicense, or provide third-party access to the Service without our written permission
  • Overload or interfere with the Service infrastructure

8. Intellectual Property

The KIXIK platform, including its interface, design, code, branding, and Smart Tag system, is owned by KIXIK and protected by intellectual property laws.

You receive a limited, non-exclusive, non-transferable license to use the Service during your active subscription period. This license does not grant you any ownership rights.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE FROM DATA LOSS. WE DO NOT WARRANT THAT THE SERVICE WILL MEET YOUR SPECIFIC BUSINESS REQUIREMENTS.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW: 10.1 KIXIK SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, BUSINESS INTERRUPTION, OR LOSS OF BUSINESS OPPORTUNITIES, EVEN IF KIXIK HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. 10.2 KIXIK'S TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY AND ALL CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE TOTAL AMOUNT YOU PAID TO KIXIK IN THE THREE (3) CALENDAR MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM. 10.3 KIXIK IS NOT LIABLE FOR DAMAGES, OUTAGES, OR DATA LOSS CAUSED BY THIRD-PARTY SERVICE PROVIDERS, INCLUDING BUT NOT LIMITED TO SUPABASE AND VERCEL.

11. Termination

11.1 You may cancel your subscription at any time through your account settings or by contacting us. Access to the Service continues until the end of the current paid billing period.

11.2 We may suspend or terminate your account immediately if you:

  • Violate these Terms
  • Engage in fraudulent or abusive behaviour
  • Fail to pay subscription fees

11.3 Upon termination, your right to use the Service ends immediately. Your data will be retained for 30 days before being permanently deleted.

12. Changes to the Service and Terms

12.1 We reserve the right to modify, update, suspend, or discontinue any part of the Service at any time, with or without notice.

12.2 We may update these Terms at any time. The updated version will be posted on this page with a new "Last updated" date.

12.3 Continued use of the Service after changes to these Terms constitutes your acceptance of the updated Terms.

12.4 For material changes, we will notify active subscribers by email at least 14 days in advance.

13. Governing Law and Disputes

These Terms are governed by the laws of the Republic of Estonia and the European Union.

Any disputes arising from these Terms or your use of the Service shall be resolved in the courts of Estonia. If you are a consumer in the EU, you may also use the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
